Arc and CMS Grants Extension of Community Rules Compliance Plan
The new CMS Rules on community services offer new opportunities for self-determination,
person-centered services and self-direction of supports/services. As I have shared with
you before, these new rules on community will have an impact on how services/supports
are delivered in the near future. No state in the nation has had their compliance plan
approved and I think Illinois is a long way from compliance because of its historical low
funding of community services.

The federal Center for Medicare and Medicaid Services (CMS) sent a letter to the
Department of Healthcare and Family Services (HFS) providing its feedback on Illinois’
Statewide HCBS Transition Plan for compliance with the revised Home and Community
Based Services rules. Director Fenton asked me to let you know that CMS has given
Illinois an extension (beyond the date specified in its letter) for responding. On
September 15, CMS granted HFS’s request for an extension to December 2, 2015.
HFS is experiencing turnover in certain key staff positions that work on this matter. We
are currently talking with HFS about opportunities for stakeholder input into Illinois’
response. CMS has confirmed that there will need to be another 30 day public comment
period prior to Illinois’ response. We will keep you posted. If you have any questions or
