Community Integrated Living Arrangements (CILA) Clarification of Family or a Person’s Own Home

Purpose
This Information Bulletin serves to clarify for people served in Community Integrated Living Arrangements (CILA), guardians, CILA providers and Independent Service Coordination (ISC) Agencies of the criteria to determine the meaning of a family or person living in their own home.
Process and Procedure
The Division of Developmental Disabilities (DDD) within the Illinois Department of Human Services (DHS) issues the following guidance to provide clarification regarding the meaning of a person receiving CILA services in a Family home or a residence the person individually controls or manages. In these instances the person applying for or receiving CILA services can be eligible to select “Family/Own Home” as part of their CILA funding options.
Selecting the “Family/Relative/Own Home” option on the CILA Application (IL462-4425) for Question #15 will:
Exclude the Room and Board funding from the CILA Rate and reimbursement; and,
Exempt the person from any third party liability for CILA services; and,
The person would not be eligible to receive Base Start-Up funding.
The third party liability is also known as the “offset.” Under this option the person receiving CILA services individually controls or manages all their income. The CILA person selecting this option will use their income, both earned and unearned, as well as any grants or rental subsidies they qualify for and receive to pay for their own residence including but not limited to mortgage or rent, utilities, telephone, entertainment, food, laundry supplies and other consumable items.
The person selecting this option may receive assistance from the CILA provider or their guardian in handling their financial matters as independently as possible. The person in conjunction with their guardian (as applicable), ISC agent and CILA provider will specify in the person’s service plan the person’s need for assistance with handling their own financial matters and how assistance will be provided if any assistance is necessary.
Use the following guidance to determine when a person selects the “Family/Relative/Own Home” option on the CILA Application:
The person to receive CILA services lives in his/her own residence for which they, or their guardian as applicable, owns the residential unit, or has signed the lease or rental agreement in their name(s); or
The person to receive CILA services lives with his or her parents, legal guardian, or other relatives; or
The person to receive CILA services lives in his/her full-time residence in which he or she determines who else may live with them in the same residential unit; and,
The CILA provider, which includes staff of the CILA provider, shall not own, lease, rent, and/or manage or control the residential unit the eligible CILA person considers to be his or her own home.
